FERST Training Solutions Pty Ltd (ABN 48 149 436 082), trading as FERST ("FERST", "we", "us"), is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy describes how your personal information is collected, used, stored, and disclosed when you visit www.ferst.com.au, enrol in training, or otherwise engage our services.
Personal information we collect
When you visit our website, our hosting provider Webflow automatically collects technical information about your device, including your IP address, browser type and version, operating system, browser language and time zone, screen resolution, HTTP headers, referring pages, and the date and time of your visit ("Device Information"). This information is collected through server log files and cookies and is stored on Webflow's servers in the United States.
We use Google Analytics 4 (GA4), provided by Google LLC, to understand how visitors interact with our website. GA4 collects information about your visit including pages viewed, time spent on pages, traffic source, device and browser type, and approximate (city-level) location derived from your IP address. GA4 may also record interaction events such as form submissions and clicks on key links so we can measure the effectiveness of our website and marketing. This information is transferred to and stored on Google's servers, which may be located outside Australia, including in the United States. You can opt out of GA4 tracking by installing the Google Analytics Opt-out Browser Add-on available at tools.google.com/dlpage/gaoptout.
When you enrol in training, request a quote, or otherwise transact with us, we collect information including your name, organisation, billing address, payment details (processed by our payment provider), email address, phone number, and — for training enrolments — your Unique Student Identifier (USI), date of birth, and any other information required under the National VET Data Policy ("Service Information").
In this policy, "Personal Information" refers to both Device Information and Service Information.
Cookies
Our website uses cookies and similar technologies, including:
- Strictly necessary cookies to make the site function (for example, remembering form input as you complete it); and
- Analytics cookies set by Google Analytics 4 to help us understand how the site is used.
Our website forms are protected by Google reCAPTCHA, which helps us distinguish genuine enquiries from automated spam. reCAPTCHA collects hardware and software information (such as device and application data) and sends it to Google for analysis. Use of reCAPTCHA is subject to Google's Privacy Policy and Terms of Service. This helps us keep our forms secure and is necessary for them to function.
You can manage or disable cookies through your browser settings. For general information about cookies and how to manage them, visit www.allaboutcookies.org. Disabling analytics cookies will not affect your ability to use the site or enrol in training.
How we use your personal information
We use Service Information to deliver training and related services, including processing payments, issuing invoices and certificates, communicating with you about your enrolment, and meeting our regulatory reporting obligations. Specifically, we share relevant training information with our accreditation partner Allens Training Pty Ltd (RTO 90909) and, where required, with the Australian Skills Quality Authority (ASQA) and the USI Registrar.
We use Device Information to operate, secure, and improve our website and to screen for fraud.
With your consent, we may also send you marketing communications about FERST services. You can opt out at any time by clicking the unsubscribe link in any marketing email or by emailing hello@ferst.training with "unsubscribe" in the subject line.
Sharing your personal information
We share your Personal Information only with parties who help us deliver our services, including:
- Allens Training Pty Ltd (RTO 90909) for accreditation and certification;
- ASQA and the USI Registrar where required by law;
- Our job-management system (Simpro) and accounting software (MYOB), our payment processor, cloud service providers, and email service providers; and
- Professional advisers (accountants, legal advisers) where necessary.
Our website is hosted by Webflow, Inc. (398 11th Street, 2nd Floor, San Francisco, CA 94103, USA). When you visit our website, technical information described above is automatically collected and stored on Webflow's servers in the United States. Information you submit through our website forms is also stored within the Webflow platform and forwarded to FERST for action. Webflow acts as our data processor and is bound by contractual obligations to handle this information consistently with our instructions and applicable privacy laws. Some of our other service providers may also store data outside Australia. Where this occurs, we take reasonable steps to ensure they handle your information consistently with the APPs.
We may also disclose Personal Information to comply with applicable laws, to respond to a lawful request, or to protect our rights.
Data retention
We retain training records for the period required under the Standards for Registered Training Organisations and the Student Identifiers Act 2014 (currently 30 years for AVETMISS records held by ASQA). Other personal information is retained for as long as required for the purpose for which it was collected, unless you ask us to delete it earlier.
Specifically:
- Enquiry data submitted through website forms is retained for up to 24 months after last contact, unless you become a customer (in which case it forms part of your customer record);
- Marketing email subscriber data is retained until you unsubscribe;
- Analytics data collected by Google Analytics 4 is retained for 14 months and then automatically deleted.
Accessing and correcting your information
You may request access to the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will respond within a reasonable time and may need to verify your identity before releasing information.
Complaints
If you believe we have breached the Australian Privacy Principles, please contact us in the first instance using the details below. We will acknowledge your complaint and aim to resolve it within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.
Do not track
Our website does not currently respond to "Do Not Track" or "Global Privacy Control" signals. You can manage tracking through the specific opt-out mechanisms described in this policy and through your browser settings.
Changes to this policy
We may update this policy from time to time to reflect changes to our practices or for legal or operational reasons. The "Last updated" date above will indicate when revisions were made.
