Terms of Service

These Terms of Service (“Terms”) govern your access to and use of theFERST Training Solutions website (www.ferst.com.au), the purchase of our services and products, your enrolment in training, and your use of any associated online platforms. By accessing our website, enrolling in a course, or purchasing equipment from us, you agree to be bound by these Terms.
1. About FERST Training Solutions
FERST Training Solutions Pty Ltd (ABN 48 149 436 082) (“FERST”, “we”,“us”, “our”) is an Australian emergency management company based at Unit 1, 2 Yallourn Street, Fyshwick ACT 2609. We provide:
• Emergency management training (face-to-face, blended, and online);
• Evacuation diagram services compliant with AS3745-2010;
• Emergency procedure documentation;
• Risk and business continuity consulting; and
• Emergency equipment and signage, where listed for sale on our website.
2. Acceptance of these Terms
By accessing our website, enrolling in a course, purchasing equipment, or otherwise engaging with our services, you agree to be bound by these Terms. If you are agreeing on behalf of an organisation, you confirm you have the authority to bind that organisation.
If you do not agree to these Terms, please do not use our website or services.
3. Eligibility
You must be at least 18 years old to make a purchase or enrol in training in your own name. Persons under 18 may participate in training only with the consent of a parent, guardian, or employer who accepts these Terms on their behalf.
4. Our Services
4.1 Nationally recognised training (Allens Training partnership)
FERST is a delivery partner of Allens Training Pty Ltd, RTO 90909 (“Allens Training”). All nationally recognised qualifications and units of competency that FERST delivers are issued by Allens Training. When you enrol in a nationally recognised course through FERST:
• You enter into an enrolment agreement with Allens Training, with FERST acting as the delivery partner;
• Your training records, AVETMISS data, and Unique Student Identifier (USI) are managed by Allens Training in accordance with the Standards for Registered Training Organisations 2015 and the Student Identifiers Act 2014;
• Your Statement of Attainment or qualification is issued by Allens Training;
• Allens Training’s student handbook, terms, and policies apply in addition to these Terms. Where there is any conflict between these Terms and Allens Training’s terms in respect of nationally recognised training, Allens Training’s terms prevail.
4.2 Non-accredited training
We also offer non-accredited training, including familiarisation sessions, evacuation exercises, and tailored emergency response training. These programs are delivered by FERST directly and are not issued by Allens Training. Participants receive a FERST Certificate of Attendance.
4.3 Online courses (Kajabi)
We deliver online courses through Kajabi, a third-party learning platform operated by Kajabi LLC (United States). When you purchase or enrol in an online course:
• A user account will be created for you on the Kajabi platform;
• Your access credentials, progress records, and course interactions are hosted on Kajabi’s servers, which are located in the United States;
• Course access is granted for the period specified at the time of purchase;
• For nationally recognised online courses, Allens Training remains the issuing RTO and Allens Training’s terms apply to the assessment and certification components;
• You agree to comply with Kajabi’s terms of service and acceptable use policy, available at www.kajabi.com.
We are not responsible for technical issues or outages on the Kajabi platform that are outside our reasonable control, but we will use reasonable efforts to assist you in resolving access issues.
4.4 Evacuation diagrams, emergency procedures, and consulting
We provide evacuation diagrams (compliant with AS 3745-2010), emergency procedures, risk assessments, and business continuity consulting on a fee-for-service basis. The scope, deliverables, and timeline for each engagement will be set out in a written quote or services agreement. Where a services agreement is signed, that agreement prevails over these Terms in respect of that engagement.
4.5 Equipment and goods
Where physical equipment, signage, or other goods are listed for sale on our website, the terms in Section 8 (Equipment Sales) apply in addition to these Terms.
5. Pricing and Payment
Prices are displayed in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. We reserve the right to change pricing at any time,but changes will not affect orders or enrolments already accepted.
Payment is required at the time of booking or purchase unless we have agreed in writing to provide credit terms. Accepted payment methods are displayed at checkout and may include credit/debit card, bank transfer (EFT), and other electronic payment methods we make available.
Card payments are processed by our nominated payment provider. FERST does not store full credit card details on our systems.
For invoiced clients, standard payment terms are 14 days from the date of invoice unless otherwise agreed in writing.
6. Cancellations and Refunds — Training
The following applies to all FERST-delivered training, including both nationally recognised courses (under our partnership with Allens Training) and non-accredited courses.
6.1 Cancellation by you
Cancellations must be notified in writing to hello@ferst.training.
• More than 7 days before course commencement: Full refund of fees paid, less any administration fees.
• Less than 7 days before commencement: Refund at our discretion. We may instead offer a credit toward another scheduled course.
• After the course has commenced: No refund. For distance or online courses, the course is deemed to have commenced when learner resources have been dispatched or when course access has been granted on Kajabi.
6.2 Extenuating circumstances
Where a student can demonstrate that extenuating or significant personal circumstances led to their withdrawal, we may exercise our discretion to offer a credit toward another scheduled course or, where appropriate, a refund of fees paid. Each case is considered on its merits.
6.3 Transfers
Where there is a legitimate reason, a student may transfer to another scheduled course without charge, subject to availability.
6.4 Cancellation by us
If FERST or Allens Training cancels a scheduled course, you will be entitled to a full refund of fees paid or, at your election, a transfer to an alternative scheduled course.
6.5 Refund processing
Approved refunds will be paid by electronic funds transfer to a nominated bank account within 14 days of written notification to cancel. Administration fees may apply.
6.6 Guarantee of Training
In the event that FERST is unable, for any reason, to deliver training that has been paid for in full, we will refund the course fees or, at the student’s election, make alternative arrangements to deliver the training.
6.7 Student Fee Guarantee (Nationally Recognised Training)
For nationally recognised training delivered under our partnership with Allens Training, Allens Training holds a bank guarantee from Westpac for the protection of student course fees paid in advance. This ensures that, in the event Allens Training ceases to operate or is unable to provide the contracted services, students have access to funds or a comparable course at no additional cost.
7. Online Courses (Kajabi)
In addition to the cancellation and refund terms in Section 6, the following applies to online courses delivered via Kajabi:
• Refunds for online courses: Refund requests must be made within 7 days of purchase AND before the student has accessed more than 25% of the course content. After this point, no refund is available unless required under the Australian Consumer Law.
• Course access: Access is granted to the named purchaser only. Sharing of login credentials or course materials with any other person is prohibited and may result in immediate termination of access without refund.
• Course updates: We may update course content, assessments, or platform features from time to time. We will not materially reduce the value of a course you have purchased without your consent.
• Technical requirements: You are responsible for ensuring you have a compatible device, current web browser, and reliable internet connection to access online courses.
8. Equipment Sales
Where we list physical equipment, signage, or other goods for sale on our website, the following terms apply.
8.1 Product information
We use reasonable efforts to ensure product descriptions, specifications,and images are accurate. Colours and finishes may vary slightly from on-screen representations.
8.2 Acceptance of orders
Your order is an offer to purchase. We reserve the right to accept or decline any order at our discretion, including (without limitation) where:
• A product is out of stock;
• There is an obvious error in pricing or product description;
• We are unable to verify payment or delivery details; or
• The order appears to be for resale or commercial redistribution.
If we decline your order, we will notify you and refund any payment made.
8.3 Shipping and delivery
We ship within Australia using nominated couriers. Shipping costs and estimated delivery times will be displayed at checkout. Title and risk in the goods pass to you upon delivery to the address you nominate.
Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by the carrier, weather, or other circumstances outside our reasonable control.

8.4 Returns and exchanges
If equipment arrives damaged or faulty, please contact us within 7 days of delivery at hello@ferst.training. We will arrange repair, replacement, or refund in accordance with the Australian Consumer Law (see Section 13).
For change-of-mind returns:
• Returns must be requested within 30 days of delivery;
• The item must be unused, undamaged, and in its original packaging;
• You are responsible for return shipping costs; and
• A restocking fee of up to 20% may apply.
The following items are not eligible for change-of-mind returns:
• Single-use or hygiene-sensitive items, including opened first aid consumables;
• Items custom-manufactured or personalised to your order, including custom signage and evacuation diagrams; and
• Downloadable digital products and online course access.

9. Intellectual Property
All content on our website — including text, graphics, logos, images, training materials, evacuation diagrams, emergency procedures, and software — is owned by or licensed to FERST Training Solutions Pty Ltd (or Allens Training, in the case of accredited training materials). The FERST name and logo are trademarks of FERST Training Solutions Pty Ltd.
You may not reproduce, modify, distribute, or commercially exploit any ofour content without our prior written consent, except as expressly permitted by law (for example, fair dealing for research or study).
Where we produce evacuation diagrams or emergency procedures for a client, the client receives a licence to use those deliverables for the operation of their facility. Copyright in the underlying templates and methodologies remains with FERST.
10. Acceptable Use of the Website
You agree not to:
• Use our website or services for any unlawful or unauthorised purpose;
• Submit false or misleading information;
• Upload viruses, malware, or other malicious code;
• Attempt to gain unauthorised access to our systems or another user’s account;
• Use automated systems (bots, scrapers, crawlers) to access our website without our prior written consent;
• Harvest personal information about other users; or
• Use our services to harass, defame, or harm others.
Breach of this section may result in immediate termination of your access to our website and services.
11. Third-party Platforms and Links
Our website and services use and link to third-party platforms, including (without limitation) Kajabi (online course delivery), Webflow (website hosting), our nominated payment processor, Allens Training (RTO services), and others. Your use of those platforms is governed by their respective terms and privacy policies.
We are not responsible for the content, accuracy, availability, or practices of third-party websites or platforms. Links to third-party sites do not imply our endorsement.
12. Privacy
Your personal information is collected, used, and stored in accordance with our Privacy Policy, available at www.ferst.com.au. By using our services, you consent to the collection and use of your personal information as described in that policy.
13. Consumer Guarantees and Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded.
To the maximum extent permitted by law:
• Our services and goods are provided on an “as is” basis and we make no warranties beyond those required by law;
• We are not liable for any indirect, consequential, special, or incidental loss, including loss of profits, revenue, data, or business opportunity; and
• Our total liability to you for any claim arising out ofor in connection with these Terms, the services, or any goods is limited to the amount you paid for the relevant service or goods in the 12 months preceding the claim.
Where we are liable for breach of a consumer guarantee that cannot be excluded, our liability is limited (at our option) to: (a) supplying the services again, or paying the cost of having the services supplied again; or(b) replacing the goods, repairing the goods, or refunding the price of the goods.
14. Indemnity
You agree to indemnify FERST against any claim, loss, damage, cost, or expense (including reasonable legal costs) arising out of or in connection with:
• Your breach of these Terms;
• Your breach of any applicable law;
• Your infringement of any third-party right; or
• Your negligent or wrongful act or omission.
15. Termination
We may suspend or terminate your access to our website, services, or online course content if you breach these Terms or if we are required to do so by law. On termination, any outstanding amounts owed to us remain payable.
Sections that by their nature should survive termination — including intellectual property, indemnity, limitation of liability, and governing law —will continue to apply.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this document indicates when the most recent changes were made. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. For material changes affecting existing enrolments, we will use reasonable efforts to notify affected students by email.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Australian Capital Territory, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.
18. General
• Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision is severed and the remaining provisions remain in full force.
• Waiver: Our failure to enforce any provision is not a waiver of that provision.
• Entire agreement: These Terms, together with our Privacy Policy and any services agreement we sign with you, constitute the entire agreement between us in respect of your use of our website and services.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations on written notice to you.
